DMCA Policy

1. Overview

Cassian™ respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1996 (DMCA), 17 U.S.C. § 512, we will respond promptly to notices of alleged copyright infringement that comply with applicable law and are properly submitted to our designated agent.

This policy applies to content accessible through the Cassian platform, including screenshots, scan reports, and any user-submitted material.

2. Filing a DMCA Takedown Notice

If you believe that content hosted on or accessible through Cassian infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include all of the following:

  1. Identification of the copyrighted work. A description of the copyrighted work you claim has been infringed. If multiple works are involved, you may provide a representative list.
  2. Identification of the infringing material. A description of where the allegedly infringing material is located on the Cassian platform, with sufficient detail for us to find it (such as a URL or screenshot reference).
  3. Your contact information. Your full name, mailing address, telephone number, and email address.
  4. Good faith statement. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  5. Accuracy statement. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on behalf of the copyright owner.
  6. Signature. A physical or electronic signature of the copyright owner or a person authorised to act on their behalf.

3. Designated Agent

Please use "DMCA Takedown Notice" as the subject line to ensure your notice is reviewed promptly. Notices that do not comply with the requirements above may not receive a response.

4. Counter-Notice

If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notice to our designated agent. Your counter-notice must include:

  1. Identification of the material. A description of the material that was removed or disabled and its location before removal.
  2. Good faith statement. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  3. Consent to jurisdiction. A statement that you consent to the jurisdiction of the courts in your district (or, if outside the United States, any judicial district in which Cassian may be found) and that you will accept service of process from the person who filed the original notice.
  4. Your contact information and signature. Your full name, mailing address, telephone number, email address, and a physical or electronic signature.

Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10–14 business days, we will restore the removed material.

5. Repeat Infringers

Cassian will, in appropriate circumstances, terminate the accounts of users who are repeat infringers. If a user receives multiple valid DMCA notices, their account may be suspended or permanently closed at our discretion.

6. Good Faith & Misrepresentation

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be subject to liability for damages, including costs and attorneys' fees. If you are unsure whether material infringes your copyright, consider seeking legal advice before filing a notice.

7. Non-US Copyright Holders

While the DMCA is a United States law, Cassian respects intellectual property rights globally. If you are located outside the United States and believe your copyright has been infringed, you may still contact our designated agent using the process above. We will review your notice under applicable copyright law, including the Berne Convention and the copyright laws of New Zealand (Copyright Act 1994).
